Terms & Conditions – Luinga Beag

Please Note:

These Terms & Conditions apply to all bookings made with Luinga Ltd, the operator of Luinga Beag (“we”, “us”, “our”).

TERMS AND CONDITIONS

All bookings are made directly with Luinga Ltd.
A binding contract exists once the required deposit has been paid and written confirmation has been issued.

Your booking should be for holiday purposes only unless otherwise agreed in writing. The Luinga Beag must not be used for party purposes, weddings or filming without prior written agreement or email confirmation of same is acceptable.

The accommodation is of a high standard and will be returned in the same condition.

Luinga ltd reserves the right to change or amend its terms and conditions at any time.

Payments, Pricing & Errors

A non-refundable deposit of £400 is required to secure the booking.
The remaining balance and any security deposit must be paid no later than 8 weeks before arrival, unless otherwise agreed.

All payments are made to Luinga Ltd.
If full payment is not received by the due date, we reserve the right to cancel the booking and retain the deposit.

In the unlikely event of a pricing or availability error, Luinga Ltd reserves the right to correct the error or cancel the booking with a full refund of any monies paid.

Cancellations by the Guest

All cancellations must be made in writing by the lead guest.

  • If cancellation occurs more than 8 weeks before arrival, the deposit is retained.

  • If cancellation occurs within 8 weeks of arrival, the full balance remains payable.

Where cancellation occurs after the balance has been paid, Luinga Ltd will make reasonable efforts to re-let the accommodation for the cancelled period.

If the accommodation is re-let:

  • Any monies recovered will be refunded minus the deposit and any reasonable costs incurred, including administration and marketing costs.

If the accommodation is not re-let, no refund will be due.

For this reason, guests are strongly advised to take out comprehensive holiday cancellation insurance at the time of booking.

Cancellations by Luinga Ltd

In the unlikely event that Luinga Ltd needs to cancel a booking due to circumstances beyond our control (including property damage, safety issues, or force majeure), we will:

  • Refund all monies paid in full or

  • Offer alternative dates, where possible

Luinga Ltd shall not be liable for any additional costs incurred by the guest, including travel or accommodation elsewhere.

Check-in and Check-out

Check-in is from 16:00 on the day of arrival.
Check-out is by 10:00 on the day of departure.

Early check-in or late check-out may be available by prior agreement but cannot be guaranteed.
Failure to vacate on time may result in additional charges.

Occupancy

The property must not be occupied by more guests than stated on the booking confirmation.

No overnight visitors are permitted.
Day visitors must be agreed in advance.

Luinga Ltd reserves the right to terminate a stay without refund if occupancy limits are exceeded.

Dogs

Dogs are the only pets allowed on the premises. No other kinds of pets are permitted. Guests must declare that they wish to bring a dog(s) at the time of booking and agree to pay the surcharge for accompanying dog(s). There is a maximum limit of 3 dogs.

Chickens, wild deer and other animals roam free around the Luinga site and it is the responsibility of dog owners to keep their dog under control at all times. Guests may be required to vacate their Accomodation if, after being warned that their dog is causing a nuisance, they continue to fail to control it. In such circumstance, no refund will be payable to the guest for the unexpired part of their stay. Any injury or death caused by a guest’s dog to a person, another dog, stock animal or wild animal is the responsibility of the pet’s owner. In cases of injury or death of live-stock, another dog or wild animals caused by a guest’s dog, Luinga ltd reserves the right to charge that guest for any applicable veterinary care or animal replacement costs.

Dogs are not allowed on the furniture and please bring your own pets bedding. If they have a tendency to chase wild animals or fight with other dogs they must be kept on a lead at all times. Any fouling close to the Luingasite, roads, foot-paths or croft field betwen Luinga and the shore line should be cleaned up by the dog’s owner. A charge of £60  will be taken from the security deposit if this is not observed i.e. if any dog faeces around Luinga site not picked upby the  dog’s owner.

There is a washing area for pets outside the house next to the bins, please use your own pet towels.

Use of the Property

The property is strictly non-smoking and non-vaping indoors.

Guests agree to take reasonable care of the property, furniture, fixtures, and outdoor areas.
Furniture must not be moved or dragged inside or on the decking.

Bath towels must not be taken to the beach or used outdoors.
BBQs are not permitted on the decking or near the property.

Waste must be disposed of responsibly and recycling guidelines followed.
Food waste, fats, oils, and hygiene products must not be disposed of in toilets or drains.

Outdoor Stone Bath

Use of the outdoor stone bath is entirely at the guest’s own risk.

Children must be supervised at all times.
Glass is not permitted in or around the bath.

Luinga Ltd accepts no responsibility for injury arising from misuse, adverse weather, or failure to follow guidance.

Wood-Burning Stove

A starter supply of logs is provided.

Only suitable firewood may be burned.
The stove must never be left unattended and must be fully extinguished before leaving the property or going to bed.

Guests are responsible for safe and sensible use at all times.

Working Croft & Rural Setting

Luinga Beag is situated on a working croft, with livestock and free-roaming animals present at certain times of year.

Guests must respect fencing, animals, neighbouring properties, and the surrounding land.
Luinga Ltd accepts no liability for incidents arising from failure to follow countryside safety guidance.

Noise & Neighbours

Guests must respect neighbouring properties at all times.

Quiet hours apply between 22:00 and 08:00.
Excessive noise or antisocial behaviour may result in termination of the stay without refund.

Maintenance & Access

Luinga Ltd reserves the right to access the property at reasonable times for maintenance, inspection, or emergency purposes.

Wherever possible, advance notice will be given.
No refunds will be issued for temporary loss of utilities or facilities beyond our control.

BBQ’S AND CAMP FIRES

You are not permitted to make camp fires or have BBQs anywhere except for at sites specifically designated for these purposes, and agreed between you and Luinga ltd.

Fuel

Heating and hot water is provided by air source heat pump, this together with electricity (excluding electric car charging) and wifi is included in your holiday rental cost. A starter pack of logs is also included and additional logs can be purchased upon request.

Wi-Fi Usage disclaimer

Wi-Fi is provided for guest convenience only. Guests agree not to use the service for any unlawful purpose, including downloading copyrighted material or accessing illegal content. Luinga Ltd accepts no responsibility for interruptions to the service or for any loss, damage, or consequences arising from its use.

Items provided

Beds are made up for your arrival. A starter supply of towels, tea towels, bin bags, toilet rolls, tea, coffee, sugar, cooking oil, and standard cleaning products is provided. For longer stays, guests are responsible for replenishing any additional items as required.

Smart TVs are provided for guest use. Streaming services such as Netflix, Amazon Prime, and NOW TV are available via your own account details.

Smoking

Smoking is not permitted inside the Luinga accommodation. You are requested to not drop cigarette ends on the ground anywhere on the site (a charge of £60  will be taken from the security deposit if this is not observed). Please take special care with your cigarette ends. Full security deposit will be retained if we believe that guest smoke inside the Luinga accommodation.

Breakages

Please inform us of any breakages or damage so we can repair or replace before our next guests arrive. Cups, glasses & plates do get damaged but any other damages and losses will be paid for in full.

Repairs to property

Occasionally in rental properties damage due to possible wear and tear, an item of equipment may for some reason not be working. We will do our utmost to repair it as quickly as possible. Due to the remoteness of our location, sometimes things may take a little bit longer than they do nearer towns & cities but we will strive to correct problems should they arrive. To improve the facilities the owner’s reserve the right to alter or amend the facilities made available at the Luinga accommodation.

Maintenance & Right of Entry

Luinga Ltd reserves the right to access the property for maintenance, inspection, or emergency purposes.

Where possible, advance notice will be given.

No refunds will be issued for temporary loss of services or facilities beyond our control.

Luinga ltd reserves the right to ask guests to vacate the property if their behaviour is deemed to be unreasonable or damage is caused to the property.

Force Majeure

Luinga Ltd shall not be liable for cancellation, delay, or changes caused by events beyond our reasonable control, including but not limited to:

  • Severe weather

  • Flooding

  • Fire

  • Utility failure

  • Travel disruption

  • Government restrictions

No compensation or refund beyond monies paid will be due in such circumstances.

Liability

Luinga Ltd accepts no liability for loss, damage, accident, injury, or theft to guests, vehicles, or personal belongings.

Guests are responsible for their own safety and are strongly advised to hold appropriate travel insurance.

Data Protection

Luinga Ltd complies with UK data protection legislation (UK GDPR).

Personal data is used solely for booking administration and legal requirements and will not be shared except where required by law.

Complaints

The owner hopes that you will not have any cause for complaint but in the event of a problem arising, you must in the first instance contact the owner immediately so that any problem may be speedily resolved, as the owner must be given the opportunity to rectify the problem. Some problems are very easily rectified if notified.

Law

These Terms & Conditions are governed by the laws of Scotland, and Scottish courts shall have exclusive jurisdiction.

 

Acceptance

By making a booking and submitting payment, you confirm that you have read, understood, and agree to these Terms & Conditions with Luinga Ltd.
